Kempegowda Layout – Allotment (2015) of Residential sites by BDA – Details & Eligibility Conditions

Kempegowda Layout is the new layout being developed by BDA (Bangalore Development Authority). BDA has issued final notification inviting applications for Allotment of residential sites in Kempegowda Layout.

After years of delay, nearly 5,000 residential sites in Nadaprabhu Kempegowda Layout will be available for the general public. It is estimated that these 5,000 sites on over 300 acres covers only the first phase of the allotment.  The sites which are being allotted in the first phase are located between Mysuru Road and Yeshwantpur, along NICE Road.

The overall plan is to develop 4,043 acres. Of these, 2,100 acres are presently in BDA’s possession where 20,000 residential sites in total will be developed and allotted in future.

As mentioned above, these 5,000 sites are being developed under the first phase. Under the second phase, around 5,000 more sites will be developed. Under the third phase, apartments will be constructed in Kempegowda Layout.

BDA aims to create 10,000 flats. Under the fourth phase, commercial spaces including offices, shopping malls and commercial spaces may be created.

BDA is giving around 60-day period to apply for these sites. The sites would be of the dimensions 20×30 sqft, 30×40 sqft, 40×60 sqft and 50×80 sqft.

Kempegowda Layout by BDA : Details, Terms & Conditions

  • Application forms are available from 02-Nov-2015.
  • Last date to submit application forms is 31-Dec-2015.
  • Where can I get Application form? – They are available with authorized bank branches of Canara Bank, Corporation Bank, Axis Bank, ICICI Bank, State Bank of Mysore and Punjab & Sind Bank. These branches are located in Bangalore and also across Karnataka state.
  • Details of total number of available sites, dimensions, site value, registration fee and Initial deposit are as below; (1 metre = 3.28 feet & 1 Sq meter = 10.76 sq feet)
  • Nearly, one thousand 20 * 30 sites(600 square feet) are reserved for Economic Weaker sections of the society. These sites are available at subsidized rates.
  • Nearly two thousand 30*40 sq ft sites, one thousand 40*60 sq ft sites and around five hundred 50×80 sq ft sites are available for allotment.
  • The per square feet rate is fixed at Rs 1,800  for 20X30 site. For EWS category, this is fixed at Rs 900 per sq ft.
  • The per square feet rate is fixed at Rs 2,000  for 30X40 site, which is Rs 24 Lakh.
  • The per square feet rate is fixed at Rs 2,200  for 40X60 site, which is Rs 48 Lakh .
  • The per square feet rate is fixed at Rs 2,500  for 50X80 site, which is Rs 98 Lakh. (This is only the allotment rate. Stamp duty and registration fee will also be applicable) 
  • Only 50% of the total sites (ie 2,500 sites) are available for General category. The remaining 50% of the sites are reserved for various categories like SC / ST / BC / Govt employees / Persons with disability etc.,

What is the procedure to apply for a site in BDA Kempegowda Layout?

  • Visit the authorized bank and pay applicable ‘registration fee’ (ranges between Rs 500 to Rs 5,000 based on the site dimension). The bank will issue a Registration card. You can then obtain the Application form at the bank (application fee is Rs 400 for general category & Rs 200 for others).
  • Draw a DD in favor of BDA, Bangalore for the requisite Initial deposit amount (as indicated in the above table).
  • Persons whose income is less than Rs 1 Lakh per annum are considered under EWS category.
  • The person applying for allotment of sites should be a domicile in Karnataka for not less than 15 years prior to the date of site registration. Age of the applicant should be atleast 18 years.
  • If you or any of your family member (spouse or dependent family member) has already been allotted any BDA / Govt site then you are not eligible to apply for allotment of site in Kempegowda BDA Layout.
  • The Initial deposit paid by you do not carry any interest. However, it will be adjusted against the total site value of successful applicants. (Unsuccessful applicants will get it refunded)

  • The last date for submission of filled in application with initial deposit and registration fee is 31.12.2015.

Should you apply for BDA site in Kempegowda (KG) Layout? – My Opinion

  • BDA reserves the right to allot sites. Kindly note that this is not a BDA e-Auction. The allotment is based on various factors like seniority, number of previous attempts (number of times an applicant has tried to obtain a BDA site), no of years domiciled in Karnataka etc., So, the basis of allotment is purely subjective. I do not think even lucky draw is conducted. So, looks like the allotment may or may not happen in a transparent way. This is my personal opinion.
  • As per my knowledge, the average market price in and around Kemepegowda Layout is between Rs 2,000 to Rs 2,500 per sq feet. The BDA sites have also been priced in the same way. It’s been a long time since BDA has come up with new Layout in Bengaluru. So, the demand for these BDA plots can be high. So, let’s monitor the demand for these BDA residential sites.
  • Check if there are any conditions applicable on ‘Re-sale’ of sites after the allotment is done. Generally, BDA does not allow immediate re-sale of its sites. So, check with BDA about this condition.
  • Getting a Home Loan sanctioned for a BDA site can be easy (subject to your eligibility).

  • Called up BDA just now. They say that the list may come in this month end or by Sept end. They are yet to get any info.

    • If it is true then what is the logic behind this?
      Is there any specific reason for punishing during month end.

      I hope It should be last week of this month or first week of next month. :)

      • True. But this is what the person said. But did not give proper clarification. I called up the number 23440480. May be if someone else picks the call the answer may vary. One can give a try.
        They should have gone with the allotment directly and objections could be dealt with in the next phase. This is creating unnecessary tension and confusion.

    I have been alloted 40*60 site @ KG layout. I have already paid 6.54 Lacks to BDA, Balance need to paid in 3 instalment.

    If an immovable property cost >50 Lac. Need to diduct TDS on the payments made/balance to pay.

    Srikant sir, please clarify how to go ahead with this TDS part here ?

    • Dear Veer,
      1 - The buyer has to deduct TDS at 1% of the total sale consideration. Note that the buyer is required to deduct TDS, not the seller.
      2 - Tax is to be paid on the entire sale amount. For example, if you have bought a house at Rs 60 lakh, you have to pay tax on Rs 60 lakh and not on Rs 10 lakh (i.e. Rs 60 lakh - Rs 50 lakh). This is applicable even when there is more than 1 buyer or seller.
      3 - This TDS has to be deposited along with Form 26QB within 7 days from the end of the month in which TDS was deducted.
      4 - After depositing TDS to the government, the buyer is required to furnish the TDS certificate to the seller. This is available around 10-15 days after depositing the TDS.
      5 - If payment is made in installments, the TDS would be required to be deducted at each such installment.

      • I spoke to BDA Authority. They said tax is not required for 40*60 Site even though its above 50 Lakhs. Others please check with BDA and let me know if you get different information. This is required while registering the property as far i have read online. Since we are doing lease agreement i feel this will not be required for time being.

    Compare to Arkavathi (De notification and other litigation),Anjanapura and other layouts(Not ready for construction even afte 1 or 2 decades completion of layout formation and allotment) how SAFE BDA layout is,how we can relay on BDA property seeing so many issues for their past so called well planned,well developed layouts??How we can believe after this government,other government don't squash entire layout allotment or formation stating previous government not done so and so things or how we can believe those who lost land(their children's or grandchildren's) will not create any issues to the allottee after some years or how we can believe local politician,rowdies will not trouble us(They know how to make litigation and problems) or how we believe layout is not on storm water drain or on lake????

    Hope you guys understood my concerns.....we will be investing hard earned money,our entire life time savings....Hope we will not be cheated,we all lead peaceful life....

        • Yes.....after discussion with Secretary during objection hearing session he mentioned i am eligible for site allotment under 2A category and refereed my objection to allotment committee and he said its now with allotment committee to take decision.

    • Eaelier someone used to tell "Nale Ba"story. Story continues as of today. Does someone have BDA allotment rule book? If so, please share. I am really surprised by the complete lack of accountability and our state of helplessness.

    • As per previous experience we used to get refund within 15 days from day final list announced...we got refund cheque via speed post....Mostly this time may transfer refund to bank account.

    Either by cheque (if by cheque then to which address they will send the cheque ?)or amount will credit to our account?
    As i am not staying in the address mentioned in the application, is there any way to request BDA to credit to my account?

    • Usually they used to send cheque to the address mentioned in application form via speed post.....If you not residing it will go back to BDA office but lot of formalites to be observed to take cheque from BDA office....

      I think this time they might transfer to our A/C...they collected details in application form...

  • The Bangalore Development Authority (BDA), in response to an article carried by TOI on August 14, "BDA violates its own allotment rules for Kempegowda Layout", has said it was an "inadvertent" mistake in the English advertisement which suggested those who own a private site/house are eligible for allotment in the layout.

    BDA officials said considering the serious nature of the blunder, the matter is being investigated. All 5,000 applications of those who have been provisionally selected for site allotment are being scrutinized again. The process began early on Tuesday morning and continued late in the evening. It is said the matter was brought to the notice of the chief minister's office and BDA was told to re-examine it.

    "... a part of the rule as shown in the report is inadvertently missing in the English notification and the provisions of the said rule are published completely in the Kannada notification. BDA has not violated any provisions of its site allotment rules," the authority stated.

    Another note issued by the additional chief secretary's office said: "BDA proposes to allot sites only to applicants who don't own a site or house and neither do their family members. BDA has no intention to deviate from the provisions of its allotment rules."

    • will they redo the entire allotment process voiding the earlier provisional list and again final confirmed list is delayed? its just a typo error in the advertise and they knew what they were doing anyway while allotting all these months isn't it? this is really confusing and speculative?

      • As per my View they will re verify provisional allotties list just to make sure sites allotted to eligible needy not greedy.... :)

        Hope allotment committee members are aware of all rules and their responsibilities,they and their supervisors are part of committee from long.....irrespective of add mistake they done their duty according to BDA rules....

          Agree, for the needy middleclass (typical salaried class) its reached to a level of desperation as neither we can afford exorbitant prices in the open market (exorbitant costs & mortgages) nor wait 15 to 20 years hoping someday BDA considers which has been a mayamruga ha ha hope!!!!!

          Hope there are no such surprise articles publishing at this juncture and things moves on to the next stage.

    • i read in todays times of India that in the advertisement of last year calling for application for KG layout sites( in English version) the BDA missed to mention that the persons/family members who already has any site including private are not eligible to apply. So they are checking all 5000 allotments now day and night to see is there anyone who has site in Karnataka has been allotted a site?

      • Yes Naveen they will post final list in both website and paste list in BDA office notice board....

        As far as payment is concern.....General category applicant already paid 12% as initial deposit rest 88% will be divided into 3 equal installments,that should be paid as per the date mentioned in allotment confirmation mail sent to our residential address which is mentioned in application. If we fail to pay within date they mentioned we need to pay rest amount with interest like 4th month 18%,5th month 24%......

          • How do we know if the final list is correct. What if people have bribed or relatives or friends of BDA officials have been included in the new list. Will Provisional list Candidate be able to file objections on final list?

          • In my view BDA official cant easily put their relative friends others name,they know everything is captured and data can be collected using RTI and can be questioned in Court.

            As far as my opinion 85-90 % allotties will be genuine ...10-15 % not sure because they allotted site under I category,Physically handicapped and some other quota,we cant validate ....We cant file objections for final list.....If someone feels final list is contains non eligible allotties they can collect details from BDA using RTI and can question in court.

          • I am 1st time applicant for 50 x 80 site under physically handicapped category and been provisionally allotted a site. i did formal application process and getting updates in this blogs only ,nothing else. contacted nobody so far.i hv 55% hearing impairment in both ears.

            so from my experience it seems to be fair allotments in time. further if u check the cut off details ..etc information are given in a transparent manner and seems less scope for arbitrariness.

          • I belongs to 2 A category,54 year old its my second attempt...As per provisional list they allotted site 35-53 year old guys under 2 A category at their 2nd attempt....after filling they are agreed i am eligible for site allotment.

            If you see this where is transparency???

          • You got chance present your case before the final that in itself good practice from BDA for the first time.

    • BENGALURU: THE final notification for the Bangalore Development Authority’s Nadaprabhu Kempegowda Layout will be out by the third week of August. The last day to file objections to the provisional list was Saturday and the BDA has already received an overwhelming number of objections to the announced list.

      The provisional list for 5,000 sites was released on July 2 and public have been invited to file their objections till July 30. A total of 1,096 objections have been received up to Thursday evening.

      Speaking to Express, the new Secretary of BDA N Shivashankar said, “We have received nearly 1,096 objections so far and will be receiving some more in the next two days. Due to the high number of objections received, we have already begun the process of hearing the grievances at our office,” he said.

      “We hope to complete the hearing of all the objections by August 10. After that, the recommendations will be placed before the allotment committee and it has to okay it. By the third week of August, the final list is likely to be out,” the Secretary said.

      With 31,349 applicants competing to get hold of the 5000 sites, the disappointment is huge for those who have lost out. This is probably the reason for the flood of objections.

      The highest number of complaints(750), have been received for the 20x30 sites under the Economically Weaker Section, under which 1,500 sites have been allotted. The 20x30 sites under the General category has received 30 objections, he said.

      Altogether 216 objections have been received for the 30x40 sites, 170 objections for the 40x60 sites and 30 objections under the 50x80 category.

      Most complaints were about applicants stressing their seniority level (number of attempts they have made for a BDA site). While the BDA has on record a certain number of attempts by an applicant, the applicant may have challans and other documentary proof to show they have tried more number of times, Shivashankar said. When asked if there would be a drastic change in the final list due to such a huge number of objections, Shivashankar said, “If the objections are found to be genuine, we will definitely include the applicants in the final allotment list.”

      The K G Layout is spread across Yeshwantpur and Kengeri hoblis in the villages of Seegehalli, Kannelli, Kodigehalli, Manganahalli, Kommaghatta, Bheemanakuppe, Ramasagara, Sulikere, Kenchanapura, Ramasandra, Kommaghatta, Krishnasagara and Challaghatta.

      The sites were announced after a minor delay as the Site Allotment Committee was reconstituted in the last minute.

    • Regarding payment , once the site allotment letter rec'd from that date within 3 months we should clear the payment. in case part payment will be paid i before 3 months. balance payable amount will carry the interest.

      Please clarify.

  • As far as my I know, registration happens only on full payment. In case one seeks staggered payment his or her registration will be delayed till the last payment. If I am wrong, kindly reply.

  • Thank you Mr.Prakash for the info. Yes, as you say we have to write to them regarding price reduction etc. Can we all arrive at one price and ask for the same ? It would have been nice if many of us joined together and submitted a letter as a group. As of now it does not seem to be possible. We are also not sure if we have been allotted due to the number of objections. Would it be better to ask them to develop the layout soon since cost of construction is increasing day by day. In another two years it may become all the more difficult to construct . let us arrive at a point so that atleast we can send similar letters.
    It is my sincere request to all of you reading this to kindly join hands and write letters for the benefit of all.
