Kempegowda Layout – Allotment (2015) of Residential sites by BDA – Details & Eligibility Conditions

Kempegowda Layout is the new layout being developed by BDA (Bangalore Development Authority). BDA has issued final notification inviting applications for Allotment of residential sites in Kempegowda Layout.

After years of delay, nearly 5,000 residential sites in Nadaprabhu Kempegowda Layout will be available for the general public. It is estimated that these 5,000 sites on over 300 acres covers only the first phase of the allotment.  The sites which are being allotted in the first phase are located between Mysuru Road and Yeshwantpur, along NICE Road.

The overall plan is to develop 4,043 acres. Of these, 2,100 acres are presently in BDA’s possession where 20,000 residential sites in total will be developed and allotted in future.

As mentioned above, these 5,000 sites are being developed under the first phase. Under the second phase, around 5,000 more sites will be developed. Under the third phase, apartments will be constructed in Kempegowda Layout.

BDA aims to create 10,000 flats. Under the fourth phase, commercial spaces including offices, shopping malls and commercial spaces may be created.

BDA is giving around 60-day period to apply for these sites. The sites would be of the dimensions 20×30 sqft, 30×40 sqft, 40×60 sqft and 50×80 sqft.

Kempegowda Layout by BDA : Details, Terms & Conditions

  • Application forms are available from 02-Nov-2015.
  • Last date to submit application forms is 31-Dec-2015.
  • Where can I get Application form? – They are available with authorized bank branches of Canara Bank, Corporation Bank, Axis Bank, ICICI Bank, State Bank of Mysore and Punjab & Sind Bank. These branches are located in Bangalore and also across Karnataka state.
  • Details of total number of available sites, dimensions, site value, registration fee and Initial deposit are as below; (1 metre = 3.28 feet & 1 Sq meter = 10.76 sq feet)
  • Nearly, one thousand 20 * 30 sites(600 square feet) are reserved for Economic Weaker sections of the society. These sites are available at subsidized rates.
  • Nearly two thousand 30*40 sq ft sites, one thousand 40*60 sq ft sites and around five hundred 50×80 sq ft sites are available for allotment.
  • The per square feet rate is fixed at Rs 1,800  for 20X30 site. For EWS category, this is fixed at Rs 900 per sq ft.
  • The per square feet rate is fixed at Rs 2,000  for 30X40 site, which is Rs 24 Lakh.
  • The per square feet rate is fixed at Rs 2,200  for 40X60 site, which is Rs 48 Lakh .
  • The per square feet rate is fixed at Rs 2,500  for 50X80 site, which is Rs 98 Lakh. (This is only the allotment rate. Stamp duty and registration fee will also be applicable) 
  • Only 50% of the total sites (ie 2,500 sites) are available for General category. The remaining 50% of the sites are reserved for various categories like SC / ST / BC / Govt employees / Persons with disability etc.,

What is the procedure to apply for a site in BDA Kempegowda Layout?

  • Visit the authorized bank and pay applicable ‘registration fee’ (ranges between Rs 500 to Rs 5,000 based on the site dimension). The bank will issue a Registration card. You can then obtain the Application form at the bank (application fee is Rs 400 for general category & Rs 200 for others).
  • Draw a DD in favor of BDA, Bangalore for the requisite Initial deposit amount (as indicated in the above table).
  • Persons whose income is less than Rs 1 Lakh per annum are considered under EWS category.
  • The person applying for allotment of sites should be a domicile in Karnataka for not less than 15 years prior to the date of site registration. Age of the applicant should be atleast 18 years.
  • If you or any of your family member (spouse or dependent family member) has already been allotted any BDA / Govt site then you are not eligible to apply for allotment of site in Kempegowda BDA Layout.
  • The Initial deposit paid by you do not carry any interest. However, it will be adjusted against the total site value of successful applicants. (Unsuccessful applicants will get it refunded)

  • The last date for submission of filled in application with initial deposit and registration fee is 31.12.2015.

Should you apply for BDA site in Kempegowda (KG) Layout? – My Opinion

  • BDA reserves the right to allot sites. Kindly note that this is not a BDA e-Auction. The allotment is based on various factors like seniority, number of previous attempts (number of times an applicant has tried to obtain a BDA site), no of years domiciled in Karnataka etc., So, the basis of allotment is purely subjective. I do not think even lucky draw is conducted. So, looks like the allotment may or may not happen in a transparent way. This is my personal opinion.
  • As per my knowledge, the average market price in and around Kemepegowda Layout is between Rs 2,000 to Rs 2,500 per sq feet. The BDA sites have also been priced in the same way. It’s been a long time since BDA has come up with new Layout in Bengaluru. So, the demand for these BDA plots can be high. So, let’s monitor the demand for these BDA residential sites.
  • Check if there are any conditions applicable on ‘Re-sale’ of sites after the allotment is done. Generally, BDA does not allow immediate re-sale of its sites. So, check with BDA about this condition.
  • Getting a Home Loan sanctioned for a BDA site can be easy (subject to your eligibility).

Kindly keep the above points in mind before applying for a site in Kempegowda Layout.

  • Hi, Can anybody tell me where are these 30x40 sites located mean to say in which block of the layout

  • NOTE This ACT/BILL passed in March 26 2016, Any project in India, should be registered under this authority in 3 Months. June 26 2016 was deadline.

    Page number 5,

    (zk) Promoter means iii) any development authority or any other public body in respect of allottees.

    BDA - Bangalore Development Authority is public body and i think the Act will apply.

    Downloand and print so that every rule can be imposed on BDA , after the allotment is done, i will send this as representation. I don't mind waiting few more months after allotment.

    REMEMBER - while reading where ever it says PROMOTER - Read it as BDA.

    No promoter shall advertise, market, book, sell or offer for sale, or invite persons
    to purchase in any manner any plot, apartment or building, as the case may be, in any real estate project or part of it, in any planning area, WITHOUT registering the real estate project with the Real Estate Regulatory Authority established under this.

    Projects that are ongoing on the date of commencement of this Act and
    for which the COMPLETION CERTIFICATE has not been issued, the promoter shall make an application to the Authority for registration of the said project within a period of three months from the date of commencement of this Act.

    REMEMBER - while reading where ever it says PROMOTER - Read it as BDA.

    19.
    (1) The allottee shall be entitled to obtain the information relating to sanctioned
    plans, layout plans along with the specifications, approved by the competent authority and such other information as provided in this Act or the rules and regulations made there under or the agreement for sale signed with the promoter.
    (2) The allottee shall be entitled to know stage-wise time schedule of completion of the
    project, including the provisions for water, sanitation, electricity and other amenities and services as agreed to between the promoter and the allottee in accordance with the terms andconditions of the agreement for sale.

    4) The allottee shall be entitled to claim the refund of amount paid along with interest
    at such rate as may be prescribed and compensation in the manner as provided under this Act, from the promoter(BDA), if the promoter fails to comply or is unable to give possession of the apartment, plot or building, as the case may be, in accordance with the terms of agreement for sale or due to discontinuance of his business as a developer on account of suspension or revocation of his registration under the provisions of this Act or the rules or regulations made thereunder.

    I don't think, state govt has implemented this.

    20.
    (1) The appropriate Government shall, within a period of one year from the date of
    coming into force of this Act, by notification, establish an Authority to be known as the Real Estate Regulatory Authority to exercise the powers conferred on it and to perform the functions assigned to it under this Act:

    GUYS, if this act is passed on properly, definitely we will get right value for our money, BDA has to announce the Exact date of possession and untill then it can only ask for money in stages not in FULL. so If BDA says we will give water supply, road, current in 2 years, for two years it has to split the money.

    Lets wait and ensure BDA is Registered under this Act.

    curious about swapping alloted sites from different dimension of the site. I have been alloted 30x40 in the provisional list and would like to swap it for a 60x40 site from anther allotee. whether is it allowed and anybody interested?

  • For all the Applicants,

    please re-think, you are about to pay double the cost for the site(for which it ideally does not worth), also we can still question the BDA authorities since BDA has not followed clear pricing factor has pointed out in this blog.

    also if you visit the below link

    you can find market value ranges between 800-900 Rs per sqft in those areas, but BDA has doubled the pricing factor without any valid reason.

    please kindly note : BDA is not providing any modern amenities (so that we can relax ourselves for their quoted price )ex : club house, swimming pool, cricket/football/tennis stadium , Convention hall / sewage treatment etc..

    also land acquisition price will be around Rs 250 persqft (by considering 1 acre = 1 crore compensation)
    even if you add nearly Rs 1000 persqft for development/betterment charges totally it will around Rs 1250 persqft.

    now you just imagine.

    Also i believe with the newly introduced Real Estate Act,
    1. No builder/company should collect the advance amount prior to launch of project.
    2. They should compulsary pay the interest if the project gets delayed.
    3. Collected amount from end users, should be committed to that project alone.

    i strongly feel we can raise our concerns for the same and i believe by doing so atleast we have some sort of satisfaction for protecting our rights.

    i feel we need some legal suggestion from the experts to move forward.

    • I agree with Sham, This is very legal. Does this Act Real Estate (Regulation and Development) Bill, 2016 apply on BDA?

  • I was allotted 50x80. I agree with the comments that price needs to revised down and payment should be spread over a period of three years or until the layout can be habitable.

    • Another additional approach will be to knock on the doors of the high court and file a writ petition stating that the price is too high considering that BDA is supposed to be a government organization and now charging more than commercial rates for the allotment. Also the advocate must argue that the purpose of BDA was to provide sites at affordable rates to the common man This also has to be given press coverage following which something positive could be expected.

      Filing the writ petition will block the BDA from collecting money from the applicants and BDA will probably consider reducing the / spreading the amount over a few years.

      Once one person files the writ petition, and makes it public, many others will follow and BDA may become at least a little bit reasonable.

      • I agree only with approaching HC which is the only source for any relief. I have worked closely with two dozen ias officers while in service and you will not get any relief. Atleast payment can be staggered for quite sometime. Let someone allotted site take lead and rest can follow and attach thier wp to first one, more number of people should approach. I have been asking whether any advocate applicant who can help us but there was nobody.

        • If no advocate is available, the applicants should approach the advocates. The fees payable to the High Court Advocate can be reduced if say around 5 - 10 applicants initially file a writ petition. Thereafter multiple applicants can either implead themselves in the same case or file fresh writ petitions. I am thinking about reducing not only the cost burden on the group of people who file the first writ petition but also reducing the followup required with the advocates

      • JK, Please let us know when you have filed the writ petition. Thanks for taking the lead.

        • If in the beginning 5 to 10 people file a single writ petition against the BDA, the filing cost and legal expenses will come down drastically instead of individually filing writ petitions.

    • I think that you need to take action by yourself by giving a representation / application to BDA to reduce the price and spread the payment over a few years. It appears that some people are not interested in getting the price reduced saying that it was already mentioned earlier. However they forget that BDA has the right to decrease or increase the price.

      Request you to file the application and post the contents here. Then others will take the cue and start filing similar applications. Quite confident that majority of the 30*40, 40*60 and 50*80 allottees will follow suit. However somebody has to start it. This has to be done asap as soon BDA will sent allotment papers and ask for the balance amount. Along with this if the application is made available to the press, I am confident that maximum publicity will be derived and BDA will at least think about reducing the price and / or spread it over a few years.

  • I am back several days later since i didnt get site and see many allottees asking for reduction in value. Friends, pl note, all applicants are educated, price is not imposed now after allotment but we know it while applying. So representation is of zero value since we are aware of price published before applying. BDA says it paid one crore per acre, is it as per guidance value? Pl check. Market vslue will always high cannot be compared to guidance value. Arkavathy got into litigation mainly because of less valuation. I think you have case only for extension of time till BDA provide sewerage, street light, road and such basic amenities, which they may take few months. This again you have to fight through court, not representation.
    There may be several objections now but how many are coming in this allotment rule, matters. Many simply raise objection just because they didnt get.
    Pl be serious in blog, confine to your requirements. You have nothing to do with recent allegation on KJ George or Present govt.
    I request all those unsuccessful like me to insist BDA to publish list of unsuccessful as per thier seniority as written by Mr.Shetty here. We will know our future status.
    I habe also enquiries of land owners site at slight premium. Can anybody guide pros and cons.

      • Not sure but may be a lakh or two. I did not show interest because lot of legal issues to be addressed as its second sale. But some sites of land owners are up for sale.

      we all fighting due to inefficient CM and just look back at the story of KJ George, how he became powerful, he dares CM to take action against him. He is a serious offender and scape goat.

        • Yes shenoy there is no point raising pricing issue,but we must fight for getting more time period to make full payment (at least 2yrs),either by requesting or legally. Further,there is no point in talking politics in this blog.

    • Considering BDA's plan to sort out objections in 2 weeks, number seems to be huge. What is the source of this data?

  • Guys, lets wait for the final list to be out, by then we will continue to discuss on the challenges here. Site value and Handover conditions are major issue for allottees and for whom the site are not allotted who quickly BDA can refund this has to discussed. Just one day before announcement of provisional list remember we all were talking to visit BDA ON MONDAY 4th July. but list got announced. lets form association and get court instruction on how the price was set 100% increase compared to guidance value. Ask for lowering the site Value.

    • I completely agree with you Ray, BDA has to revise the price what they have quoted, we need to form an association and represent for the same.

  • Why can't the BDA start refunding the money for non-allottees for the fresh & 1st attempts. I'm sure these people names will not be there in the Final list of allottees even somebody has any objections.

    • Sad News awaiting to all. Minister KJ George is involved in the suicide of Dy SP Ganapathi.
      Now opposition government will start sacking KJ George and with this sudden development, all our efforts either getting response or refund is taken for granted.

      You can't find a government like Mr.Siddaramiah now nor in future, he is ultimate genius, no words in dicationery to abuse him
