Sir, We have a newly built complex under Thane Municipality Jurisdiction.  The Complex is more than 2 years old (3 buildings of 2 wing / 8 floor each + One 20 Floor Tower). Now builder is asking us to get the society registered. But the none of the buildings are having Completion Certificate and Occupancy Certificate. Builder is promising that O.C. will be available soon, but let the society formation been done. But we came to know that still he has not got the Completion certificate for any of the buildings. So how will he get O.C. soon. In this scenario will the registration of society is advantageous or is of disadvantage. Please advise.

Hi,
Looks like, your builder is trying to act smart.   When most of the buyers have taken possession of the flats, generally then an association
should be formed for conducting the affairs of the society/flat owners in the complex.

Without having OC & CC, it is not advisable to form a Society.

All the flat owners may form as an unofficial group and insist on issuing the OC to the flat

Sir, Unfortunately all the Flats are occupied. So shall we hold the formation of Society till we get Completion As well Occupation certificate.

Ideally the answer is YES. Generally, the builder will create the Society, will maintain the property for few months and then transfer it to the Residents. If required, do take legal opinion too.
