I work in Merchant Navy still abroad, have transfered some money from Nre to my wife SB Ac which she invested in Bank fd's approx 8-9 different, starting since Jan 16 for 3 months & renewing as waiting to purchase house, now some of the amount my son's have given approx 25% & mine share is 75% 1 Who will pay tax 2 If clubbing arises then which form to fill by me and should my wife also file ITR 3 Is there any way to tell tax dept that husband has filed and what should my Wife do in ITR, if need to file Can i file from net as 31 july is last date for 15-16 FY Thanks

Hi Mr. Reddy, i have a query –
Will a person be a NRI
1. Stayed in UK for 5 months on work.visa and then goes to Uk for 2 months on tourist visa
2. Stayed in Uk for work visa for 5 months and then for 2 months in Singapore on business trip where salary is credited in india and per diems paid in singapore. In this case if person is NRI where does he pays tax coz he does not complete 183 days in any country. UK tax will be refunded, in Indua tax will have to be paid for only income earjed in india.

Hi , Kindly note that rules of clubbing of income comes into picture if you gift a certain amount to your spouse, or minor children or Son’s wife. Any income earned by the recipient on the gift shall be clubbed with the income of donor (you). Read: Gifts & Income Tax implications. 1 - You have to pay taxes on the interest income earned on FDs. 2 - The type of form depends on sources of income. Kindly read below article : http://www.relakhs.com/new-itr-forms-ay-2016-17-tax-return-filing/ 3 - She can also file ITR even if no tax liability is there, just to show the Gift money as 'Exempt income' in ITR. Yes, you can file on IT dept's e-Filing website. Else, it is always advisable to take help of a CA.
