Sir, I joined PSU 1968, went USA 2002 taking permission & E.Leave sanctioned 44 days. Applied extension on medical grounds which was refused n service terminated in 2003. Leave Encash 144 days was sanctioned in 2005. Advise being terminated employee, am I eligible for Gratuity & Encashment. Not being released despite reminders. Being sick, i am not so mobile. Pl advise other options available to me. Is max limit gratuity in my case will be 3.5. Regs

Dear Sir, You mean to say that the mentioned benefits are yet to be paid to you by your ex-employer?? Gratuity is payable on Termination as well. The maximum limit has been increased to Rs 20 Lakh now (subject to necessary amendment). But, the rules that were applicable during your employment period can be different. Suggest you to kindly consult a CA and get this work done.
