we have ceased paying housing loan emis\' since the builder has allotted our flat to someone else and other flat to us...it\'s a clear case of fraud..Here i want to know is that the bank is taking out the property to auction ...we also have filed case in consumer court...so is it a matter of concern to us...if bank auctions the property. we get our refund based on what...agreement value or the amount we paid till date ...and from which date..from the date of booking or from the date of possession letter handed over to . how much compensation can we demand for this fraugery...its from the year 2014. can we also ask compensation for OC..even though we now want to cancel our flat

Hope, you have the allotment letter (with flat details) with you. Was home loan sanctioned for wrong flat? Is it still an Under-construction property?
Without going through the documents in detail, will not be able to provide suggestions in this regard.
Kindly consult or follow it up with a civil lawyer..

Does the Sale deed/allotment letter mention about the Location details as well? If so, then you will get the justice.

If so, kindly go ahead with your case @ consumer court, do consult a trusted civil lawyer as well. Speak to your lender on this as well and advisable not to skip paying EMIs (as of now)..

yes sir…bank has the allotment letter..we have sale deee.yes home loan was sanctioned for wrong flat…flat no. hasn’t been changed..but location is diff…i.e. we registered flat next to lift..but promoter is allotting us flat next to staircase without changing nos.
