Hello sir, I am from Kurnool.  We have four siblings to our father.  We have an ancestral house at Kurnool.  Unfortunately, my father was missing in the year 1993.  since then, we have found missing our father.  More than 20 years happened since his missing. My father had not given any WILL at that time.  Now, at this time. the property is in the name of my father in Patta issued by Govt. Please intimate how the ancestral house will be got in the name of us.  We two brothers and two sister.  We decided to take two parts in the name of two brother.  How it is possible, please advise and what legal procedure to be adopted by us. Hi, Kindly note that all legal heirs can have equal share in an ancestral property, including your mother. (Sorry to say this : Legally, where a person disappears or is missing, such a person as per law is presumed to have died if he is not heard of for a period of seven years.) And, I am assuming who have filed an FIR with the police long-time ago. If there are multiple owner for a property, and if one of the co-owner wants to transfer his/her rights in the property to another co-owner(s) then this can be done through the execution of RELINQUISHMENT DEED. The ones who would like to share the property can submit legal heir certificate, Police FIR details etc at the local civic body (municipality or corporation) office and get the Mutation of the property done.
