I am interested in purchasing a BDA site allotted in 1982 which on lease cum sale aggrement till 1992. Owner applied for condition sale deed in 1990 and build 800sft building with building permission of ground 600 sft , first floor 600sft. His property tax has fixed based on 800sft to Rs 3100. He paid tax till 2010 and stopped. Now in 2018 he re-paid all property tax from 2010 to 2018 with fine and applied for absolute sale deed now with latest EC and katha. Can be procede to purchased this site. He is looking for aggrment for 50% amount and balance during registration after 3 months during which he has to vacate the house which is on lease.
I also seen another A katha property which is in between two BDA alloted property. Is BDA noc is required for this A katha property.
Most say not required. Few says that I may be troubled if you need to demolish and build a new constrution there
Please clarity on above two issues

Is the first property given on Lease to some tenant by your prospective Seller?
Based on the given info, 1st property looks ok to me.
Second property : How come an A Khatha property is in between BDA allotted properties?? Is this in BDA layout?

More info on second site. In 1982 it was agriculture land shared by father among him self and four sons by partition deed. out of fater share of 6 sites one site was purchased by rajan. Dont know about other sites. later BDA acquired the area in 1985 except four sites in which already building is built. Later BDA alloted the number. With this method Rajan site is inbetween two BDA sites. Still we see the sequence serial number . But the Rajan has not cared to get the BDA number saying that his site is not alloted from BDA. Near by residents say that I can purchase this site, but BDA or MUDA will not permit for new construction.

I dont think there can be any issues from BDA if this site has A-Khatha and necessary approvals like Conversion order, building sanction plan etc.,
You also have to go through Family settlement deed and legal heir structure..
