A Person  has Two houses first is in Udaipur and Second is in Chittorgarh. The Couple along with their minor children stay in Udaipur. Couple's Married son with his wife live in house at Chittorgarh One portion of House property at Chittor is given on rent. My question- 1)First option may be that house at Udaipur is considered self occupied and house at Chittorgarh is considered let out .In such case my question is since one portion is used for residential purpose of house at Chittor then even the whole house will be considered to be let out? 2) Secondly whether house at chittor can be considered as self occupied and house at Udaipur is deemed let out. Even one portion is given on rent of house at chittor

Hi, Ideally and legally, it is prudent to go with the first option, as a portion of property @ Chittorgarh has been given on rent. It can be considered as a let-out one and whatever rental income you are deriving from it can be considered for the calculation. Suggest you to kindly consult a CA as well.   Related articles : https://www.relakhs.com/understanding-tax-implications-of-income-from-house-property/ https://www.relakhs.com/self-occupied-property-tax-hra-home-loan/ https://www.relakhs.com/income-tax-deductions-list-fy-2018-19/
