I have purchased a Flat in an Apartment at Bangalore City during 2009. The Apartment Association unregistered all these years. The MOA, Byelaws and mother documents not available with Association. For the monthly maintenance collected from the Owners and Accounts not maintained properly. No transferency in the Management. No Audits of Income and Expenditure Accounts. The management controlled by groupism. The proceedings of the meetings, Resolutions etc not properly recorded. PAN is not applied.
The Apartment consists legally 4 Floors but 5th Floor is constructed unauthorisedly. Each Floors consisting 9 Flats. There is a litigation between Landlord & Builder for the quality of construction of the unauthorised 5th Floor.
Is it possible to register the Association under abovementioned condition of AOA. To register presently what is the procedure.
Please guide.
