sir,
I am great fan of your real estate articles. Influenced by your BDA e-action article I have applied for e-auction at BTM1 Layout Tavarekere site no66 of 139.5 sqmt (30×50) and own as the highest bidder with bid amount 144450 per sqmt (Min bid was 103050 per smt) on 29/9/2018 at 17.30 hour since action was keep on extending in increment of 5 minutes with every bid after 1600 hours.
Since I need to pay 25% bid amount (48Lakhs) with in 72 hours, I liquidated my FD of 40Lakhs and went to BDA to get vocher to pay.
BDA Finance officials said meeting is going on to decide the successful bidders list and info will be sent on your email then only you can pay.
At about 12.30 I got the email in mobile stating that my bid is rejected with out assigning any reason. I immediately went of FM section and saw two more highest bidders like me who are also rejected. BDA cleark guided me to a officer who told that reason for rejection is highest bid not up to the BDA expectation of higher than 2,00,000 per sqmt, They will call for again with in a week and bid for highest amount to get the site, He say BDA has right to reject bid with out any reason. Is it fair when they announced minimum bid and action goes 40% higher than minimum bid.
Total list of sites rejected are No 57, 62, 65, 66, 67,68,82, 83,84,85
only 6 sites were accepted are 45,71,49,48 (They are adjacent sites bid by single individual as told by an affected person there) 68,69
Can you guide what legal action can be take to get action site

This is with reference to Auction Site No. 66 in BTM 1st Stage, Sy.No.50 of Tavarekere notified by BDA vide E- Auction Notification No.BDA / EM / E-Auction / T-05 / 2018-19 dt: 19-9-2018. Your offer of Rs.1,40,550-00 per sq.mtr has been rejected.
Necessary advice will be sent to E-Governance Department for initiating refund of the initial deposit of Rs.4.00 lakh remitted by you for the said auction.

Dear vijaya kumar,
Sad to know this development! It is very unfair on part of the civic body to reject the highest bids without any valid/proper reason. 
I have observed the auction bids getting closed at even minimum basic price itself. BDA has accepted those bids. Really surprising!
But, BDA reserves the right to accept/cancel the bids, I believe. They might have followed the rules (may be these rules are favorable to them and can be one-sided).
My suggestion would be, try reaching out to other Bidders (as mentioned in the above query, whose bids have also been rejected) , form as a group, approach a Civil lawyer and check if you can file a PIL against the BDA or not.

Rejected my plot in SMV layout. I was the only bidder. These people haven’t even sent my EMD money back so that I can apply for new e-auction. They won’t even receive calls office numbers. Always expect us to go to their office to get things done?!

Hi..Generally, they re-fund EMD within 30 to 45 days.
