Hi, I have finalised a BDA plot in JP Nagar Bangalore. The seller is in Saudi Arabia, he has given GPA to his father to sell the property. Here are my questions: 1. Can we go for the land agreement with the GPA? 2. Can we go for the land registration with the GPA? 3. It is self aquired property of the seller. Do we need to get sign from sellers wife also? Dear Ram, 1 - Yes, you can.. But GPA should have been registered at the Sub-Registrar office. There have been numerous litigation in the past on the real estate deals done through GPA transactions. Try to convicne the seller to be in India for the Registration. Do take help of a lawyer for the entire process. 2 - Yes. Proper transfer of title and ownership cannot take place, if the sale is done through a POA and not by means of a sale deed. A GPA holder has to execute a sale deed for the transfer of title. 3 - Not required, but advisable to get her sign as a witness.  Does he has any other legal heir(s)?
