Dear Sreekanth, You guided us in the matter of Sima. Now please guide us in the matter of Mina. Mina is a widow, no children, getting income from Family Pension and Rent. She will file her return first time. At present her age is 54 years. Mina’s husband Gambhir retired in the year 2013 from a bank and died in the month of May, 2015. His ITRs were filed (manually) up to AY 2015-16 (FY 2014-15). As she has no legal knowledge, Mina has not filed his deceased husband Gambhir’s ITR for AY 2016-17 (FY 2015-16). After death of his husband, Mina has two house properties. Her one flat is self-occupied and another is given on rent w.e.f. December, 2016. Her income is from (1) house rent, (2) Family Pension, (3) Interest from Savings Bank Account and (4) Interest on Bank Fixed Deposits. No other income. Can she file ITR-2 in her name, including the income of her deceased husband (S.B.A/c interest in a single return for AY 2017-18? (I think, as time lapsed, she cannot file ITR for AY 2016-17 now.) Please guide us in the matter. You may suggest any other details that we should know. Thanking you in anticipation.

Hi, Yes, for filing a Belated return, the time has been lapsed. Did she get any 'non-filing of ITR' notice (in her husband's name) for the last two FYs? She can file ITR 2 form. No, she not yet received any notice from IT Department. Her husband's income was below taxable income.

Yes, as she is the legal heir. But, kindly take help of a CA and file her ITR.
