Dear Sir, Please go through and Kindly clarify
  1. Am I eligible for HRA exemption or deduction under 80GG?
  2. Can 80GG be calculated for 9months?
  3. If yes, please mention the amount.?
#1 April to June 2016 : I was a employee of a company and HRA is part of salary. Gross 115561.00,Net pay 95604.00 and HRA 34669.00.I stayed in company quarters and no HRA exemption in FORM 16 #2 July to 21st November 2016 : I am jobless, no earnings and stayed in a rented house in Chennai. for 9500 per month. #3 21st November 2016 to March 2017: I worked for consolidated salary of 100000.00 and stayed in the same rented house. Employer was deducted tax @ 10% on monthly basis (No HRA) #4 I have my own house in Vizag where my parents alone are staying. No home loan, No rent and not claiming any benefits as self occupied. Kindly explain this. #5 House owner is not ready to give any receipts or PAN for the rent paid. Thanks and regards. D.Prabhakar,

Dear Prabhakar, Have you ever claimed any tax rebate on your self-occupied? (till-date) In case, you claim 80GG and if there is a compliance notice from the IT dept, how can you justify your stand if you do not have any documentary evidence? (owner not providing rent receipts)??

Dear Sreekanth Sir, 1.During House loan repayment period Principal  and interest components were informed to employer and claimed under eligible sections. Loan amount was completely paid.   2.Rental agreement is the only document available with me.   3.Returns were filed (ITR4) through a local consultant considering 9 months rent and total income (F.Y) minus 80C ,80TTA up to 80GG   4.If we are wrong ,kindly advise me how to go for filing revised return.   5. Since mine is of very rare situation many TRP'S unable to give  proper solution.   6. I am honest to disclose every thing and being an Engineer I am unable to fully understand your tax laws. Many people are not really patient enough to listen to us even after paying fees.   Many thanks for the reply,   D.Prabhakar

Dear Prabhakar, If you do not have rent receipts then suggest you not claim then under HRA/Sec 80GG, if you want to be honest. You may REVISE your ITR by removing these amounts and re-file your ITR.

Dear Prabhakar, In case you own any residential property at any place, for which your Income from house Property is calculated under applicable sections (as a self occupied property), no deduction under section 80GG is allowed.
