Dear sir, 3 sons, 4 daughter, Including my mother . children for my grand father.my grand father ( passed away 40 years back ) having a 2 acres agriculture land in ramnagar. Which is came through from his father after dividing property with his brother. My query is will daughters get the equal share for above said property. Please advice….

Genealogical order :
Grandfather had 4 acres agricultural land & 2 sons & divided the land equally to his 2 sons during his period.
Father ( passed 40 years back ) acquired 2 acres in above said way. & having 3 sons, 4 daughters, & passed away 40 years back without divided the property to his children.
Mother ( one of daughter for above serial no. 2 )

My query is will my mother get the equal share in above said property ?
& is it ancestor. or self acquired property ? & what is the share to my mother in both type of property. Please advice ..

Hi, An ancestral property 'should not have been divided or partitioned by the previous three generations'. So, in this case, the property has become a 'self-acquired property'. As the property (2 acres) has not been divided and also no written WILL is available (assumption), all the legal heirs will have equal claim on the property as per Hindu Succession Act (assuming the religion as HINDU).
