Khatha Registration & Khatha Transfer in Bangalore

What is Khatha?

Khatha literally means, account. It is a document that shows a property owner having an account with the Municipality or any civic authority (BBMP -Bruhat Bangalore Mahanagara Palike) for paying taxes. The details of a it include the property owner’s name, size/measurement of property, location,built-up area, vacant or occupied etc., and is essentially required to calculate the total tax payable on that property.

You need it to apply for electricity (BESCOM) and water (BWSSB) connections, for trade and building licenses, building plan approval. It is also one of the important documents to be submitted to a bank when you are applying for a loan.

Difference between A Khatha and B Khatha?

There is no B-Khata as such. Few years back, the extent of area under BBMP jurisdiction was extended and City Municipal Councils / Village Panchayats were brought under BBMP limits. This is when property owners’ details were entered in B-Register maintained by BBMP and acknowledgments were issued just to facilitate tax collection process.

The point to note is, not all B-register properties are unworthy. I personally involved in one property deal wherein the seller of a property had all the required documents like Conversion order, uptodate betterment charges receipts etc and it’s just that his property was not under BBMP limits earlier. He got his property converted to A-Khatha. But, ofcourse money/ time needs to be invested and may have to face lot of bureaucratic hurdles.

Types of  Applications:

Khata registration for newly allotted plots or Khatha for the first time.

Khata for transferred properties.

Khata for bifurcated properties.

Khatha for amalgamated (combined) properties.

NOTE: In case of revenue properties where conversion has not been obtained and approval of the competent authority for formation of layout has not been obtained, Khatha Registration will not be done unless they are regularized by the Government. However for the said properties assessment will be made for property tax and entered in the ‘B’ Register.

Khatha Transfer

For Transfer of Katha from one person to another based on the documents like sale deed, will, gift deed, family partition, release deed, in respect of properties already having khatha:-

  • Application in prescribed form
  • Title documents, flow chart of the title
  • Copy of upto date tax paid receipt
  • Affidavit regarding / inheritance / gift / court decree.
  • Original Death certificate in case of Kathadar’s death

  • Application in prescribed form
  • Copies of Registered title deed
  • Tax paid receipts
  • Sketch showing the bifurcation of the property and its measurements
  • NOC from BDA if the property is located in BDA layout (for vacant lands)

  • Affidavit regarding proof of blood relationship

My experience:

I had applied for Khata transfer in 2008 at BBMP, Bommanahalli office through a middleman. Along with the application I had submitted Sale deed, last property tax paid receipt, previous owner’s Khatha details, Encumbrance Certificate (EC) and required fee. I got Khatha transfer done in 15 days after few follow-ups.

On Khatha registration;

I had bought BDA auction site in HSR Layout for which I got Khatha registration done at Bommanahalli BBMP (CMC) office. I had submitted  registration application, Possession certificate,Sale deed, Latest Encumbrance Certificate (EC) reflecting the current owner name and Demand Draft (DD) for khatha registration and property tax.

Now we can apply for Khata through online module.

If you are applying as a group (say all flat owners of an apartment) then this is the best option. You may visit BBMP Citizen Service Centers for more information.

    Hi sir Vinod here regarding to property issue of my anscetor property ,for my grandfather 4 sons and their entered into partioned deed in 1977 written but no seal in that deed according to that property is divided yo all 4 members and have documents and again in 2004 their with in family 1 and last son of my grand father enteredd into partioned deed that time by mistake 2and 3 sons property as entered into that partiondeed and 4th son property their putting site and selling but in that all 4 members of my grandfather sons have not signed in that deed ,is that deed valid or not and can 4 th son can claim his own property ,, pls reply need ur help

    Hi sir my name Vinod we have property in horamavu their r 4 sons it is a ansetor property and thwir entered into partiondeed but no seal and sign in that accordinf to that their set all documents in their names it is in my father name ,everything is divided and all documents r up-to-date in my father name , now wat is problem means while registering some other property at that time their put some other sy no and registered ,it as been done by only two persons not whole 4 family members but we don’t have any documents of that land ,that property owner telling u have registered that land , and their tellimg now u dont have any rights to one more land now can we sell that land wat is in my father name pls suggest me wat to do now .

    I would to inform we are three brothers and one sister all got married my sister stay separate we have ancestor property in richmond town recently i have lost may dad and mom…..During my dad alive return will for 3 brothers equally share and one third value give cash to my sister…We have agreed to pay cash accordingly to property value.
    She sent the injunction order and return OS number in the building …..We would to transfer khata in our name .
    Please suggested us in this regard.

    • Dear Ramesh,
      Injunction order is a court order. So, you also may have to take legal route only.
      But, it is better to speak to your sister openly and settle this issue amicably (out-of-court settlement).
      Once, the issue is sorted out, you can go for Khata transfer.

    I am planning to buy a flat in Electronic city phase 1. When we approached a lawyer with the documents provided by the builder, he says that the khata is not valid as it is a hand written one. He says the valid once is only E Khata. Is that correct ? What can be done to obtain the E khata ? The builder says that E khata is not available with the Hebbagodi Panchayat and the available one in only the old style hand written one. is it safe to buy the flat ? Can we re-sell it at later point of time without any issues ?

    • Dear Krishna,
      Your lawyer might be right. You may ask your builder to get e-Khata done in his name.
      You may also visit the panchayat office and try to find out if e-Khata can be issued for the said property.

    • Dear Subramani..I believe that site should be at least 600 sq ft to get Khata bifurcation done (assuming this property is in Karnataka). I am not very sure if the rules have changed now.

    I am planning to buy a plot in Bidadi which is BMRDA approved. The seller has provided Form-9 and Form-11 Khatha documents(In which there is no property-ID only Name and other stuffs details have been mentioned).
    But 1 year back Bidadi is moved to Municipal town limits. So i had asked the seller for E-KHATA. Seller had initially agreed for it. But now he says that E-Khata is not possible in Bidadi Municipal town and has given me FORM-3(Saying this the Khatha ceritficatie).
    Can you please tell me whether i can go ahead with buying the plot? And ask for Seller do the Khatha transfer.

    Also let me know,is FORM 3 is Khata certificate?

    I am going to buy a independent house in Bangalore by taking a home load, property type is khata B and betterment charges are not paid yet.

    This property (site)given from government to SC/ST , I had purchased land in 2001 from SC/ST.
    Ever since, I have been paying the taxes regularly every year. The tax receipts are in my name.

    • Dear Santhotsh ..Kindly visit the BBMP ward office and can get this done. Generally it takes 2 to 4 weeks of time. Refer to above article for the required documents list.

    I m planning to buy a site near nelamangala which comes under Bangalore north taluk, Bangalore district. The seller has got POA from the actual owner. I hv verified in DC office regarding DC conversion it is proper. Now I m asking fa khata he is just pushing days.. N tells he can give manual khata but asks not to track any where. He says it is b khata only. Plez guide can I go ahead or shld I drop. Also he is not giving title deed says to the owner its ancestral property.

    I did not know that the property tax has to be pain until few months back.

    Are the any agency or company who can apply khatta on my behalf and pay the property tax for all these year and get current.

        Buyer is not insisting on Khata. Question is about Registration.

        Can the Buyer get the Registration done without the Khata?

        I had the property registered when I took over from Purvankara. All Registration charges, Taxes etc are all paid and up to date and have receipts.

        In other words ” Will the registrar refuse to register if there is no Khata?”

    I have purchased site from JR Urbania which is in chandapur anekal road. This comes under Anekal planning authority. Initially they said that they will do e-khatha transfer. But now they are saying any site purchased after 1-12-2015 needs to pay 1% tax on registration value.

      What is e-khata?
      The khata extract which was given to the site owners as form 9 and 11 previously is not converted into online form which is called e-khata. The registers at Panchayat office are getting converted into online database. We think it should reduce corruption.

      How is e-khata different?
      e-Khata contains owners photo, site photo, plan approval records, land conversion details and everything else you need to know about a property ownership and authenticity.

      How does e-khata help?
      In selling, it is required by Sub-Registrar for making any sale registry. For buyers it gives detail record of land and ownership. For House/site owners, it is a good record of land, encumbrance and ownership with photograph and summary of all details of the property.

    When i applied for Khata transfer, the due process of verification of relevant records was followe dna then a document called Uttar Patra was issued. Is this the Khata? If not then what needs to be done next to get the final Khata certificate? Kindly advise.

    • Dear Prashant,
      Before a Khata is processed, a document named as ‘Uttarapatra’ (acknowledgment of application) is generated and given to the applicant.
      Did you submit the required documents?
      The applicant is normally asked to submit a notarized copy of the Sale deed, latest Tax paid receipt, EC from the date of registration until current date, betterment charges receipt (if applicable) and old Khata document (in case of transfer), following which the applicant will receive the Khata.

        Thanks for the prompt reply. Yes, i was asked to submit the above mentioned docs (although not sure if they asked the old Khatha doc). Thereafter within a few days a group of BBMP officials came and inspected the property and asked me to come to the ARO’s office within a week’s time. When i went there, there was one person from among the group who had visited to verify the property. He handed over the Uttarpatra On the Uttarpatra it has been mentioned that “it has been recorded in the books that the Khata has been transferred from the old owner to me”. Hence i thought that this would have been the end of the process. Later i got to know that there is one further step to be taken to get the Khata Patra . Not sure what has to be done to get the Khata Patra after having got the Uttarpatra.

    You mentioned thru online module one can apply for khata cert but the link provided does not take us to the module. Can we really apply it online by attaching all scan copies of our house docs without having the need to visit bbmp office ?

    For flat in raghuvanahalli, kanakpura road, sumo leaves which bbmp office has to be visited to apply for khatha if online application is not possible ?

    I am planning to purchase a property nearby electronic city. It is B-khata property and comes under BBMP. Seller purchased land in 2014, but still now they are not paid tax and not transferred Khata to in her name. Now she wants to do khata transfer activity, but in BBMP- Bomanahalli , officers telling that , up to September 2016, they are unable to do khata transfer and to give tax receipt in her name.
    My query is – if I registered the property in my name now,
    1) Is it possible to transfer khata in my name afterwards?
    2)how khata will be transferred to my name without transferring to seller name?
    3) OR shall wait until khata has to transfer to seller first.

    I purchased a B Khata vacant land of 750 Square Feet near Kodigehalli/Hebbal, I had gotten the B Khata registration done last year in the BBMP office. Now, the same BBMP office claims it’s a fake B Khata Certificate and are demanding for 7000 INR for reissuing a new B Khata certificate, I am unsure if the new B Khata also turns out to be a fake one.
    I was not given the Khata Certificate by the vendor whilst registering the property on my name, however based on Sale Deed and Encumbrance certificate can I proceed for a Khata Registration or I should go for Khata Transfer, also to add the EChallan for paying the tax still reflects the old owner name.

    As A GPA holder I bought a plot for my NRI brother an E khata panchayat plot in Kannur area.
    Village president said to pay 1% of sale value of the plot, i.e. 30,000 for my 30Lakh registered value.
    In BBMP , 2% on registration charges applicable, which is reasonable.
    Could you comment on the govt charges and service charge to the Panchayat office?

    We have bought a E Khata plot ( Panchat Limit ) 3 months ago. When I approach Panchayat president , he said 1% of register value should be paid as government charges , i.e 30,000 for my plot registered at 30Lakh value. Usually the amount should be 2% on the registration value in BBMP . Could you please clarify it.

    and additionally some bribe . How much usual bribe in this case?

    For an NRI who has GPA here, do we need to provide any additional docs ?

      I too have bought an E-auction site (BDA).
      At the time of applying for Khata Transfer, you just need to enclose a DD towards payment of Property tax dues in the name of BBMP Commissioner.
      PC is not applicable for individual plots. However you should have got Allotment letter from BDA.
      Location MAP – They have not asked me.
      I have just submitted Sale Deep Copy, application form (you can also get it at BBMP help centres or BBMP ward office), DD for property tax, DD for Khata Registration & allotment letter copy.

    • Dear Indumathi..You may first kindly contact BBMP office and find out about the possibility of Khata transfer on your property. If you do not get property response then you may go ahead with the middle-man.

  • IN MY APARTMENT, ALL THE 7 FLATS WERE ISSUED A KHATA BY ARO CONCERNED. I PURCHASED A FLAT ON 2ND SALE WITH A KHATA FROM THE IST OWNER WHO HAD PAID PROPERTY TAX UNDER A KHATA FOR THE PREVIOUS FOUR YEARS. WHEN I APPLIED FOR KHATA TRANSFER AND PAID TAX, ARO ISSUED B KHATA AND ISSUED TAX AS B KHATA WITHOUT MY NAME. ON ENQUIRY, OTHER 6 FLAT OWNERS ALSO FACED THE SAME FATE AS B KHATA ON PAYING TAX.

    THIS PROVES THE BUILDER WHO SOLED THE FLATS BRIBED THE ARO AND GOT A KHATA ISSUED TO ALL OWNERS. WHY SHOULD WE POOR OWNERS SHOULD SUFFER FOR THE ILLEGAL A KHATA ISSUED ON BRIBE? WE WOULD NOT HAVE PURCHASED SUCH ILLEGAL FLATS. ONE OF OUR FLAT OWNES HAS MOVED HIGH COURT, WHO IS STILL SITTING ON THE CASE WITH DELIVERING THE ORDER, ALTHOUGH COURT CONDEMNED BBMP FOR SUCH ILLEGAL KHATAS AND BBMP ASSURED OF NOT REVOKING A KHATA. BUT COURT RULING IS STILL AT LARGE

      1 – No.
      2 – Now BDA wont issue Khata. You have to get it from BBMP only.
      3 – No
      4 – I believe that for B khata you wont get the certificate and you can only pay Property tax etc and the same will be recorded in the B-register of BBMP.

    We have a property which was purchased under my name as I was small the sale deed was done under with my mom as guardian for my property in 1992 now I’m trying to apply for katha, is it possible to get it now is there any law that I can’t get it after so many years

    • Dear Thejaswini,
      Property was purchased in your name when your were minor and when u attend majority you become the absolute owner of the property. I believe that you can get Khata transfer done to your name.

    I have purchased a flat recently and it is B-khata, the land belongs to two people and they made MOU with developers to build apartments. Now few of us as flat owners decided to get the Khata, Please advice us on the formalities to be followed and other things to take care.

    Thanks for the article! Wanted to check something, would appreciate any response. We had a site which we purchased a few years back. Recently, we got the B-katha done by submitting all the sale deeds including the title deed. The katha has the right name, but when we go online to pay the tax for the property we still see the old owner’s name. Is this normal? If not, what is the best way to correct this?

    I am planning to take a property which is in BBMP area and the house is B katha(panchyath approve),owner is ready to convert it to A katha. Is it possible to pay betterment charges and convert it in to A katha and what is the process, please let me know. Thanks in advance!

    • Dear SNS..It is possible if all the documents are clear and in-place. You may ask your prospective seller to convert it to A-Khatha to his name and then you can buy the property (afterwhich you can do the Khata transfer to your name).

    I had purchased a Gramantha Panchayat site 3 years back. I wanted to transfer Katha to my name. When i went and inquired for the Katha transfer, they told me the owner of the site who has given the Katha is a forged one. Iam confused. Called the owner but not getting proper response. Please let me know what i should do in this case? The officer of Gramantha Panchayat informed me that all other documents are proper.

    • Dear Vishwa..Suggest you to first apply for Khata extract and try to find out in whose name the katha has been entered and then take action accordingly.

      Kindly visit your BBMP ward office and submit below documents;
      Application in prescribed form
      Copies of Registered title deed
      Tax paid receipts
      Sketch showing the bifurcation of the property and its measurements
      NOC from BDA if the property is located in BDA layout (for vacant lands)
      Applicable fee/charges.

    I had purchased land in 2003. Ever since, I have been paying the taxes regularly every year. The tax receipts are in my name. However ,the Khatha certificate still shows the old owner’s name. Should I be concerned about this?

    Another question I have is, can someone get the khatha transferred into their name, without a sale deed?

      Probably it is a B-Khata (B Register) property. Kindly visit nearest BBMP/Panchayat office and get more information about the property’s Khata details.
      Valid & latest sale deed have to be submitted to get Khata transfer done.
